The New York State Bar Association recently released Insurance Law Practice, Third Edition, a compilation of New York insurance law-related topics. Kevin Merriman was invited to contribute to two chapters. Chapter 2: Trigger of Coverage, discusses four general trigger-of-coverage theories for long-tail losses: Exposure Theory, Manifestation Theory, Continuous Trigger Theory, and “Injury-in-Fact” Theory. In Chapter 3: Single or Multiple Occurrences, he provides an in-depth overview of the multiple theories used to analyze the number of occurrences in complex coverage claims.
